Melon Up! Celebrating Sundia Watermelons Video Contest  

Official Rules

No purchase necessary to enter or win.

  1. CONTEST PERIOD: The contest begins at 12:01 AM Pacific Time Zone on July 4, 2008 and ends at 12:00 AM Pacific Time Zone on September 21, 2008.


  2. ELIGIBILITY: This contest is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry and who submit original videos they have personally created and uploaded to YouTube as described below. Employees of Sundia Corporation, its affiliates, its advertising or promotion agencies, and their immediate family members (defined as parents, children, siblings and spouse, regardless of where they reside) or those living in the same household of each are not eligible. All federal, state and local laws and regulations apply.


  3. TO ENTER: Create an original video referencing Sundia watermelon(s). The video must be at least 30 seconds long but no more than five (5) minutes. (Any videos exceeding five minutes will be disqualified.) Beginning at 12:01 AM Pacific, upload your video to your YouTube account. If you do not have an account, follow the instructions to sign up for membership. (Registration is free.)

    After posting your video, visit www.sundiafruit.com to register for the contest and submit your YouTube video URL. You will then need to go to the Sundia Watermelon YouTube group, http://YouTube.com/group/sundiamelon, join the group and add your video. Your use of the YouTube website is subject to the Terms of Use governing that site.
  1. ENTRY CONFIRMATION & APPROVAL: Once you’ve registered your entry at www.sundiafruit.com, you will see a receipt confirmation on your browser of your submission. At this point, the Sponsor will review your submission for compliance with the Official Rules. Once your submission is reviewed, you will receive an email at the email address you provide during registration that states whether or not your Entry has been approved for Entry into the Contest. If your submission is declined approval, your confirmation email will detail the reasons why.


  2. THE SUBMISSION: Only original submissions that are personally created will be eligible to win. The video can be in color or black and white and must be original work. The video cannot contain any copyrighted material, including any statements, music, and animations. Submissions cannot contain any corporate logos or brand names, except the trademarked Sundia assets provided on www.sundiafruit.com. Videos cannot contain any disparaging statements regarding the Sponsor or material that is obscene, pornographic, or otherwise deemed objectionable at the Sponsor’s sole discretion.

    If the submission contains any person(s) other than the entrant, by entering the contest, the entrant agrees to receive permission from other persons appearing in the video for the Sponsor to use their likenesses for publicity including posting on website(s). If the person(s) is a minor in their state of residence, permission will be received from a parent or legal guardian. Entrant agrees to provide written copies of such permission(s) upon request.

    You must adhere to YouTube’s technical requirements for submission, saving your submission in the format with which it was originally created. If you are the winner, you will be required to provide Sponsor with your Submission in its original format.
    The content is totally up to you. As long as you adhere to Submission guidelines outlined in this section, you can educate us, make us laugh, or cry. You can do a stand-up routine about Sundia melons, write a commercial about Sundia melons, educate us on how you or your family and friends enjoy watermelons, write a jingle and choreograph a dance – it’s totally up to you. Let your imagination run wild! And you can enter as often as you wish.
    All video submissions must be primarily in English.
  1. JUDGING: Entries will be judged by the Sponsor and its affiliates based on the following criteria: Originality and creativity – 50%; Overall Appeal – 25%; Likelihood to motivate people to eat more Sundia watermelon – 25%. In the event of a tie, the tied entry with the highest online rating will be declared the winner. In the event of a tie in online ratings, the entry with the highest number of views during the Contest period will be declared the winner.

    Winners will be notified by email and or phone and or mail at Sponsor’s sole discretion.
  1. PRIZES: (1) Grand Prize – A $5,000 check. Any required taxes and any applicable witholding and reporting requirements are the sole responsibility of the winner. No substitution.


  2. WINNER: Winner will be posted at www.sundiafruit.com/watermeloncontest/ by October 1, 2008.


  3. CONDITIONS OF PARTICIPATION: By entering this contest, the Entrant certifies that they are the sole and exclusive owner and rights holder of the Submission and grants the Sponsor and its affiliates, agents, and licensees the unconditional and perpetual right and permission to reproduce, edit, store, copy, transmit, publish, exhibit, display, broadcast, use and reuse Entrant’s Submission without limitation to the number of times. The Entrant also waives intellectual property rights, privacy/publicity rights or other legal or moral rights and provides Sponsor unconditional permission and rights to use Entrant’s name, likeness, and photograph in any and all media without limitation to time or territory without additional compensation or approval from the Entrant or any other party, unless prohibited by law.

    No responsibility or liability is assumed by the Sponsor or Contest Parties for technical problems or technical malfunction which may affect the operation of the Contest, including but not limited to computer or video equipment; incorrect or inaccurate transcription of entry, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers; failure of any email to be sent or received for any reason, including inaccessibility or unavailability of an email account used in connection with the Contest; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest.

    Sponsor is not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Sponsor reserves the right at its sole discretion to cancel, terminate, or suspend the Contest.

    Entrants agree that these Official Rules are governed by the laws of the state of California, USA.
